El presente estudio busca describir fenomenológicamente la forma que exhibe la pena en el cuerpo, después de la pérdida de un ser querido. Para esto, se consideran las hipótesis de movimiento centrı́peto orientado a la autoafección, y movimiento centrı́fugo aludido a la ruptura de la intercorpereidad. Ambos movimientos, hacen referencia a la sensación ambigua que el cuerpo vive en la pena asociados a la presencia y ausencia del otro que ya no está, ya que el dolor provee un estado de (...) desincronización temporal que vuelve simultáneos el presente-pasado y presente-futuro. Esto trae como consecuencias, la contracción y extensión del cuerpo a partir de la maleabilidad de sus propios lı́mites. (shrink)

The alignment problem in the context of large language models must consider the plurality of human values in our world. Whilst there are many resonant and overlapping values amongst the world’s cultures, there are also many conflicting, yet equally valid, values. It is important to observe which cultural values a model exhibits, particularly when there is a value conflict between input prompts and generated outputs. We discuss how the co- creation of language and cultural value impacts large language models (LLMs). (...) We explore the constitution of the training data for GPT-3 and compare that to the world’s language and internet access demographics, as well as to reported statistical profiles of dominant values in some Nation-states. We stress tested GPT-3 with a range of value-rich texts representing several languages and nations; including some with values orthogonal to dominant US public opinion as reported by the World Values Survey. We observed when values embedded in the input text were mutated in the generated outputs and noted when these conflicting values were more aligned with reported dominant US values. Our discussion of these results uses a moral value pluralism (MVP) lens to better understand these value mutations. Finally, we provide recommendations for how our work may contribute to other current work in the field. (shrink)

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

In this paper, I argue that if one is already an advocate of scientific realism, then one would be also a realist about laws of nature. To show this, I argue that only scientific realists would accept that non-accidental regularities require explanation and that their genuine explanation is given by laws of nature. Then, from this conclusion, it seems that scientific realists have reason to believe that there are laws of nature in an objective sense. If this is correct, the (...) conclusion is that there are no reasons for advocates of scientific realism to be skeptics about laws of nature. (shrink)

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. RESUMEN En este artículo se presentan las semejanzas y diferencias entre las concepciones de la naturaleza de Darwin y Goethe, discutidas por tres filósofos alemanes: Friedrich Nietzsche, Ernst Cassirer y Georg Simmel. La discusión se centra principalmente en reconocer el método histórico del cambio caprichoso funcional por parte de los tres filósofos, como un principio estructuralista de la metodología histórica y las diferencias sobre los enfoques explicativos: el goethiano morfológico y el darwiniano funcionalista. Nietzsche y Cassirer integran en sus filosofías (...) aspectos de la teoría morfológica goethiana, y aunque reconocen en la teoría de Darwin la importancia de la explicación histórica, rechazan lo que ellos consideran la permanencia de la explicación teleológica en la teoría de Darwin. Por otra parte, Simmel establece una relación entre las concepciones de Goethe y Darwin, por medio del concepto de acción, mediante éste, intenta disolver la dicotomía formalismo-funcionalismo. En este trabajo presentamos los fundamentos teóricos de una propuesta para el abordaje didáctico de concepciones teleológicas de los y las estudiantes en la enseñanza de la Biología. La propuesta en cuestión supone acudir al modo en que Darwin lidió con las concepciones teleológicas dominantes entre sus contemporáneos, para proponer una estrategia general a través de la cual se podría incidir sobre las intuiciones teleológicas de los estudiantes, de modo que se pueda facilitar el aprendizaje de la teoría de la (...) selección natural. Sugeriremos también que esta propuesta implica un modo original de apelar a la analogía entre el cambio teórico en la Historia de la Ciencia y el aprendizaje de las ciencias. (shrink)

This research tackled the challenges public secondary schools in Sagbayan District, Bohol, faced regarding records management. The study employed a mixed research design, combining both descriptive-qualitative and descriptive- quantitative methods. The qualitative phase involved conducting in-depth interviews and focus group discussions with relevant stakeholders involved in records management. On the other hand, the quantitative phase utilized survey questionnaires to gather data from relevant stakeholders to determine the acceptability of the proposed MIS among end-users. The first phase findings revealed various challenges (...) in records management faced by the schools, such as inefficient manual record-keeping systems, difficulties in data retrieval, and the risk of data loss due to inadequate backup procedures. These challenges highlighted the need for a comprehensive, technology-driven solution to streamline records management processes and ensure data security. The evaluation results in the second phase showed that the developed Management Information System (MIS) was well-accepted among the end users. The absence of any significant difference in the level of acceptability among the participants further validated the system's suitability for addressing their specific needs. The successful implementation of the MIS proved to be an effective solution to the records management challenges faced by the public secondary schools in Sagbayan District, Bohol. (shrink)

According to John Searle, default positions, i.e., those intelligibility and action presuppositions, are some departing points from which pre-reflective and pragmatic assumptions are made. Postulating such points helps us deal with certain perennial philosophical issues, by leaving them aside. These problems are the existence of the external world, truth and facts, “direct” perception, the meaning of words, and causality. In this article, we argue that those default positions described by Searle constitute a default humanity, and their absence would dehumanize us. (...) This is particularly relevant in a default position: cooperation, which is the basis of collective intentionality and the milestone of human civilization. (shrink)

Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. Este trabajo examina si la pregunta “¿puede pensar una máquina?” ha sido respondida de manera satisfactoria. La primera sección, justamente, examina el dictum cartesiano según el cual una máquina no puede pensar en principio. La segunda trata sobre una rebelión en contra de Descartes, encabezada por Babbage. A su vez, la tercera describe una segunda rebelión encabezada por Turing. En ambas se examina, primero el lenguaje mentalista/instrumentalista para describir a una máquina programada y segundo, el reemplazo de la pregunta por (...) el Juego de la Imitación. En la cuarta sección sostengo que la evidencia aportada por dicho juego nos devuelve a la pregunta, pese a Turing. Por último, la quinta sección versa sobre cómo la Habitación China de Searle, paradójicamente, apoya el dictum cartesiano, y lo hace porque tal experimento mental se basa en una capacidad mental falible: la introspección. Se concluye que la pregunta acerca de si puede pensar una máquina es derivada de otra pregunta filosófica compleja: la de la naturaleza de lo mental y el problema mente-cuerpo. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. We argue that there is no tension between Reid's description of science and his claim that science is based on the principles of common sense. For Reid, science is rooted in common sense since it is based on the idea that fixed laws govern nature. This, however, does not contradict his view that the scientific notions of causation and explanation are fundamentally different from their common sense counterparts. After discussing these points, we dispute with Cobb's and Benbaji's interpretations of Reid's (...) views on causation and explanation. Finally, we present Reid's views from the perspective of the contemporary debate on scientific explanation. (shrink)

News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

El trabajo desarrollado por las kellys o camareras de piso se caracteriza por encontrarse dentro de lo que se podría denominar como «trabajo de cuidados», aunque se inscribe de lleno en el campo productivo y es una parte vital del sector turístico. Su caso es un claro ejemplo de la intersección entre la precariedad y la invisibilidad de unas tareas que han sido histórica y culturalmente asignadas a las mujeres y condenadas al menosprecio social. En un contexto como el actual, (...) cabe preguntarse sobre las condiciones sociales que subyacen a este colectivo y las implicaciones que se derivan de su situación de invisibilidad en un sector tan precario como el turístico dentro del Estado español, así como sobre el papel de Las Kellys –como asociación– en la reivindicación de los derechos laborales de las trabajadoras. Analizaremos su caso como una muestra de movimiento político y social que lucha por la visibilización de las tareas de cuidados y que contribuye a la repolitización de dichos trabajos en el ámbito público. The work done by the Kellys, or apartment waitresses/cleaners, is characterised by it lying in what could be called “care work”, despite being completely undertaken in the production field and forming a vital part of the tourism sector. Their case is a clear example of the intersection between precarious work and the invisibility of some tasks that have been historically and culturally appointed to women and condemned to social scorn. In today’s context, it is worth considering the social conditions underlying this group of workers and the implications that stem from their situation of invisibility in such a precarious sector as the tourism one in the Spanish State, and the role played by the Kellys, as an association, to claim these female workers’ employment rights. We will analyse their particular case as a clear example of the socio-political movement that struggles to make their care work visible and contributes to the repoliticisation of their work in the public domain. Some Comments on de Melo-Martin and Harris.

In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Esta tesis doctoral analiza el potencial de una crítica ética sobre la continua necesidad de acelerar, crecer e innovar, así como de hacer todo disponible para el turismo. La hipótesis es que la dinámica conformada por estos aspectos puede afectar a las formas de vida y menoscabar la capacidad dialógica para la resolución de conflictos de quienes se encuentran implicados o afectados por el turismo. A partir de un estudio sistemático e interdisciplinar de la cinética del turismo, esta tesis analiza (...) la naturaleza coercitiva y cultural de sus motores aceleratorios y de sus manifestaciones, y amplía el margen de reflexión de la ética del turismo a través de la teoría crítica de la resonancia de Hartmut Rosa. Se concluye que la resonancia ofrece una base compatible con el modelo de ética procedimental exigido por el pluralismo ético y por las demandas de justicia que puede contribuir a hacer frente a los retos que la cinética plantea en el turismo a través de instituciones, prácticas sociales y modos de socialización. This doctoral thesis examines the potential of an ethical critique on the constant need for acceleration, growth and innovation, and to make everything available for tourism. The hypothesis is that the dynamics created by these aspects can affect life forms, and undermine the capacity for dialogue for conflict resolution among those involved or affected by tourism. Taking a systematic and interdisciplinary study of the kinetics of tourism as its starting point, this thesis analyses the coercive and cultural nature of the engines of its acceleration and its manifestations, and broadens the scope for reflection on the ethics of tourism through Rosa’s Resonance Critical Theory. It concludes that resonance offers foundations compatible with the model of procedural ethics required by ethical pluralism, and the demands of justice, which could help to address the challenges posed by kinetics in tourism through institutions, social practices and modes of socialization. O objetivo central deste estudo é fazer ressaltar as características dos conceitos de animismo, magia e feitiçaria a partir das perspectivas de Sigmund Freud e Bronislaw Malinowski. Em um primeiro momento, analisaremos o animismo. Em seguida, uma vez que as observações etnográficas de Malinowski divergem daquelas de Freud, examinaremos a magia e a feitiçaria com a finalidade de verificar não somente as divergências, mas também as convergências e as aproximações possíveis que existem entres estes dois pensadores e os próprios conceitos (...) entre si. Por fim, mostraremos o que está no centro dessas análises e quais são as razões que fundamentam esses métodos e as resistências que eles podem suscitar. (shrink)

Environmentalism is an extremely topical movement that does not seem to obtain results in the long or short term. In this text I defend that this "failure" of environmentalism is due to the fact that both he and his public operate with an ontology contrary to their own bases. Faced with this, a new ontology is necessary that adapts to these. That is why I will show, through Graham Harman, that speculative realism is this new ontology capable of providing environmentalism (...) with what it needs to be effective. (shrink)

Taiwan and Vietnam have taken successful measures to combat the spread of COVID-19 at the early stages. Many authors attributed the successful policies to the lessons learned by these countries during the severe acute respiratory syndrome (SARS) pandemic in 2002.(Ohara, 2004) This manuscript provides a summary of recent early-stage policies that were successful in mitigating the spread and creating resilience against the negative consequences of COVID-19 in Taiwan and Vietnam. Crucially, these policies go beyond and complement social isolation. As social (...) isolation is expected to have a negative socio-economic impact on the population and adherence is likely to decrease with time(Armitage and Nellums, 2020; Weems et al., 2020), it is important to consider a broad range of policies to promote a steady control of the COVID-19 spread. Initially, we provide a brief introduction to some general concepts related to COVID-19. Thereafter, we introduce a concise review of policies and their dates relative to the first detection case in Taiwan and Vietnam as well as doing a comparative analysis. (shrink)

The status of art in Plato's philosophy has always been a difficult problem. As a matter of fact, he even threw the poets out from his ideal state, a passage that has led some interpreters to assess that Plato did not develop a proper philosophy of art. Nevertheless, R. G. Collingwood, wrote an article titled “Plato's Philosophy of Art”. How can it be? What could lead one of the most important aesthetic scholars of the first half of the twentieth century (...) to make this thesis about Plato? To understand Collingwood's position at that time, I will review it in a new light: his own philosophy of art at that moment as it was propounded in Outlines of a Philosophy of Art, a work he published that same year. I will also examine how Collingwood's position changed when he returned to the same subject in 1938, on the publication of The Principles of Art. Finally, I will end this article defending the correctness of Collingwood's earlier interpretation of Plato's position on art. (shrink)

En The paradox of Addition and its dissolution (1969), Mario Bunge presenta algunos argumentos para mostrar que la Regla de Adición puede ocasionar paradojas o problemas semánticos. Posteriormente, Margáin (1972) y Robles (1976) mostraron que las afirmaciones de Bunge son insostenibles, al menos desde el punto de vista de la lógica clásica. Aunque estamos de acuerdo con las críticas de Margáin y Robles, no estamos de acuerdo en el diagnóstico del origen del problema y tampoco con la manera en la (...) que se proponen solucionarlo. En esta medida, en este texto mostraremos cómo la Regla de Adición sí trae problemas semánticos que pueden ser planteados desde diferentes perspectivas contemporáneas, como la extensionalidad del condicional, los principios proscriptivos y la validez conexiva. This article aims to develop a new account of scientific explanation for computer simulations. To this end, two questions are answered: what is the explanatory relation for computer simulations? And what kind of epistemic gain should be expected? For several reasons tailored to the benefits and needs of computer simulations, these questions are better answered within the unificationist model of scientific explanation. Unlike previous efforts in the literature, I submit that the explanatory relation is between the simulation model and the (...) results of the simulation. I also argue that our epistemic gain goes beyond the unificationist account, encompassing a practical dimension as well. (shrink)

I start by defining sentience and giving an analysis of the epistemological problems that plague its scientific study; this consists mainly in justifying that the attribution of sentience is underdetermined by the data. Second I show that as a result of this situation of underdetermination, most of the types of arguments used to infer sentience from the data are inconclusive and lead to a stalemate. Third, I argue that the stalemates arise from a foundationalist epistemology which needlessly leads to skeptical (...) conclusions; as an alternative, I propose to adopt a coherentist framework and defend a process of ‘epistemic iteration’ (Chang 2004) within that framework, which I argue gives us a way out of the underdetermination. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

This study developed and validated E-learning Self-directed Interactive Modules (E-SelfIMo) for Earth Science. The study employed Research and Development method, using the Borg and Gall development procedure, in creating eight e-modules using Kotobee software, evaluating them by experts and students, and determining their effectiveness in terms of students' conceptual understanding. Experts agreed that E-SelfIMo met the DepEd standards for non-printed learning materials, and students attested to their high validity in content, format, and usefulness. Pretest and posttest results for the effectiveness (...) of E-SelfIMo revealed that students exposed to the E-SelfIMo have progressed from “Near Mastery” to “Near Full Mastery” in the chosen Earth Science topics, showing more significant improvement in their conceptual understanding than the control group. This study concludes that E-SelfIMo supports interactive, active, and self-directed learning thereby, improving students’ motivation, engagement, interest, and performance. El artículo analiza el rol que cumple la confianza en la construcción de la realidad social, argumentando que constituye uno de sus componentes esenciales. Lo es porque hace posible el nacimiento, permanencia y reconocimiento colectivo de las instituciones, así como su iteración y organización en subsistemas.

In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. In 2015 the United Kingdom (UK) became the first nation to legalize egg and zygotic nuclear transfer procedures using mitochondrial replacement techniques (MRTs) to prevent the maternal transmission of serious mitochondrial DNA diseases to offspring. These techniques are a form of human germline genetic modification and can happen intentionally if female embryos are selected during the MRT clinical process, either through sperm selection or preimplantation genetic diagnosis (PGD). In the same year, an MRT was performed by a United States (U.S.)-based (...) physician team. This experiment involved a cross-border effort: the MRT procedure per se was carried out in the US, and the embryo transfer in Mexico. The authors examine the ethics of MRTs from the standpoint of genetic relatedness and gender implications, in places that lack adequate laws and regulation regarding assisted reproduction. Then, we briefly examine whether MRTs can be justified as a reproductive option in the US and Mexico, after reassessing their legalization in the UK. We contend that morally inadequate and ineffective regulations regarding egg donation, PGD, and germline genetic modifications jeopardize the ethical acceptability of the implementation of MRTs, suggesting that MRTs are currently difficult to justify in the US and Mexico. In addition to relevant regulation, the initiation and appropriate use of MRTs in a country require a child-centered follow-up policy and more evidence for its safety. (shrink)

To explain the evolutionary emergence of uniquely human skills and motivations for cooperation, Tomasello et al. (2012, in Current Anthropology 53(6):673–92) proposed the interdependence hypothesis. The key adaptive context in this account was the obligate collaborative foraging of early human adults. Hawkes (2014, in Human Nature 25(1):28–48), following Hrdy (Mothers and Others, Harvard University Press, 2009), provided an alternative account for the emergence of uniquely human cooperative skills in which the key was early human infants’ attempts to solicit care and (...) attention from adults in a cooperative breeding context. Here we attempt to reconcile these two accounts. Our composite account accepts Hrdy’s and Hawkes’s contention that the extremely early emergence of human infants’ cooperative skills suggests an important role for cooperative breeding as adaptive context, perhaps in early Homo. But our account also insists that human cooperation goes well beyond these nascent skills to include such things as the communicative and cultural conventions, norms, and institutions created by later Homo and early modern humans to deal with adult problems of social coordination. As part of this account we hypothesize how each of the main stages of human ontogeny (infancy, childhood, adolescence) was transformed during evolution both by infants’ cooperative skills “migrating up” in age and by adults’ cooperative skills “migrating down” in age. Con su teoría crítica de la resonancia, Hartmut Rosa ha propuesto las bases de un modelo para evaluar normativamente y afrontar en la práctica las consecuencias de la aceleración social y su inherente tendencia al crecimiento y la innovación. Dicho modelo ha supuesto una bocanada de aire fresco en la Teoría Crítica para reflexionar sobre una dinámica que atraviesa la práctica totalidad de las actividades sociales. No obstante, también ha sido asociado a determinadas características que podrían hacerlo merecedor de dos (...) calificativos siempre reprobados por la Teoría Crítica: el paternalismo y el totalitarismo. Con el fin de contribuir a los debates suscitados por el trabajo de Rosa, la pretensión de este artículo es mostrar el modo en que su planteamiento pretende sortear esas acusaciones al apoyarse especialmente en el concepto de Weltbeziehung [relaciones con el mundo]. The paper discusses the structure, applications, and plausibility of the much-used parallel-case argument for workplace democracy. The argument rests on an analogy between firms and states according to which the justification of democracy in the state implies its justification in the workplace. The contribution of the paper is threefold. First, the argument is illustrated by applying it to two usual objections to workplace democracy, namely, that employees lack the expertise required to run a firm and that only capital suppliers should (...) have a say over the governance of the firm. Second, the structure of the argument is unfolded. Third, two salient similarities between firms and states regarding their internal and external effects and the standing of their members are addressed in order to asses the potential and limits of the argument, as well as three relevant differences regarding the voluntariness of their membership, the narrowness of their goals, and the stiffness of the competition they face. After considering these similarities and differences, the paper contends that the the parallel-case argument provides a sound reason in favor of democracy in the workplace—a reason, however, that needs to be importantly qualified and that is only pro tanto. Este artículo analiza el modo en que la teoría de la resonancia formulada por Hartmut Rosa permite revitalizar el debate sobre las condiciones que pueden minar las bases para el diálogo en las sociedades aceleradas sin apoyarse en el concepto de (...) ethos, sino en el de modo de relacionarse con el mundo [Modus der Weltbeziehung]. This article asks the question, ``what is reliable machine learning?'' As I intend to answer it, this is a question about epistemic justification. Reliable machine learning gives justification for believing its output. Current approaches to reliability (e.g., transparency) involve showing the inner workings of an algorithm (functions, variables, etc.) and how they render outputs. We then have justification for believing the output because we know how it was computed. Thus, justification is contingent on what can be shown about the algorithm, (...) its properties, and its behavior. In this paper, I defend computational reliabilism (CR). CR is a computationally-inspired off-shoot of process reliabilism that does not require showing the inner workings of an algorithm. CR credits reliability to machine learning by identifying reliability indicators external to the algorithm (validation methods, knowledge-based integration, etc.). Thus, we have justification for believing the output of machine learning when we have identified the appropriate reliability indicators. CR is advanced as a more suitable epistemology for machine learning. The main goal of this article is to lay the groundwork for CR, how it works, and what we can expect as a justificatory framework for reliable machine learning. (shrink)

The author considers that the Penal Sciences face a wide range of human pathogenic issues, ranging from terrorism and human trafficking to corruption and the use of substances and are, thus, the ideal discipline for investigating the various scientific issues and the implementation of the scientific findings arising from such investigations. He also believes that the Penal Sciences, being inextricably linked to human values and constitutional rights, are, by their nature, beneficial towards the promotion and consolidation of values, such as (...) freedom, solidarity and, especially, Social Justice. The latter concept is perceived by the author not only as a form of justice, which provides everyone with their due of proportion to their value, according to the famous saying of Ulpian “suum cuique tribuere”, but rather as a form of restitution from social injustices and as a treatment for social needs, particularly for our fellow human beings who are marginalized by society in conditions of poverty and degradation. It is interesting, at this point, to emphasize that the United Nations, in an important report from 2006 entitled “Social Justice in an Open World. The Role of the United Nations”, defines Social Justice as the fair and compassionate distribution of the fruits of economic growth (“Social Justice in an Open World. The Role of the United Nations”, edited by the International Forum for Social Development, New York: United Nations, 2006, p. 7, available online). The vision, therefore, of a society focused on goals such as combating socio-economic disparities and providing effective assistance for the weaker members of society signifies, especially in this period of Crisis, is a primary objective worthy, according to the author, of captivating us. Perhaps, indeed, the new target for Criminal Policy, following that of Restorative Justice, should now be that of Social Justice and, in fact, with a double project and aim: first for a fairer distribution of social goods and, also, for greater solidarity towards the weaker members of society. Indeed, it is a known fact to those involved with the Penal Sciences, that a dominant contemporaneous trend is that of Restorative Justice, in the sense that Criminal Law and Criminology finally have to address the needs of the victim of a criminal act and to advocate for relevant methods for extrajudicial settlements and for the conciliation of the offender and the victim. Restorative Justice is, hence, based on the triptych of the perpetrator assuming responsibilities for their actions, of restoring, as far as possible, the effects of the injurious actions against the victim and, also, of actively expressing the desire for conciliation with the victim. Certainly it would be greatly desirable if these ideas were to be consolidated within Greek legislation, albeit within the, always progressive, Greek Law for Minors there is a provision for the reformatory conciliation measure, pursuant to article 122 case e of the Greek Penal Code. However, the author believes that in this period of time, a time of profound crisis at all levels, there is need for more than simple offender-victim conciliation. There is a need for this spirit of reconciliation and solidarity to be extended to benefit all those who are experiencing hard times and may, therefore, in their deprivation and frustration, are led to committing crime. The author, at this point, refers to all the socially weak and often marginalized groups of people, who are scientifically characterized as "weak" or "vulnerable" and who try, with great courage, to survive without breaching the threshold of breaking the law. It is apparent here, according to the author, that if Criminal Policy actually aims to provide solutions to the problems of crime, it should not solely be limited to repairing the damage and conciliating the victim and perpetrator, but it should strike against the causative factors of crime and the primarily socio-economic inequalities and other forms of injustice which cause, according to Aristotle in his "Politics" (V. 1301b27, 1301a32 et seq., 1266b40), social reactions, attitudes and – Ι would add - a sequence of serious criminal acts. In other words, another kind of Justice is required in addition to Restorative, so that it may become the mission of our Criminal Policy to eliminate the injustices and inequalities that lead to crime. Tomando en cuenta las críticas más importantes a la teoría de los individuos transmundanos, así como algunos argumentos en relación con el esencialismo de origen, este artículo trata el problema de la identidad de aquellos individuos a través de mundos posibles. Proponemos la noción de mundo admisible como un tipo especial de modelo en Lógica Intensional, que, dentro de otro modelo, permite el mapeo de la historia e identidad de los individuos en diferentes mundos posibles. Esta propuesta sugiere una solución (...) plausible para determinar propiedades esenciales empíricamente relevantes ostentadas por los individuos transmundanos, un método eficaz para evaluar su identidad y, finalmente, una nueva perspectiva desde la cual reexaminar el clásico debate entre realismo y antirrealismo en la Filosofía del Lenguaje. En el presente trabajo se parte de que la innovación requiere transmisión de información. En la actualidad, el contenido de la transmisión de información se halla sometido a una regulación legal, habitualmente la propiedad intelectual, donde los agentes intervinientes y su requisito de sistema de permisos dificultan la transmisión libre. Para solucionar esta problemática, se están promoviendo dos tipos de soluciones: el primero mediante código legal y el segundo mediante código informático. Estas soluciones, que se fundamentan en razones morales, tienen (...) consecuencias políticas y determinan el modelo de sociedad que podemos construir mediante el conocimiento transmitido. (shrink)

Two major lines of argument support the notion that Hildegard of Bingen’s metaphysics is peculiarly gynocentric. Contra the standard commentary on her work, the focus is not on the notion of viriditas; rather, the first line of argument presents a specific delineation of her ontology, demonstrating that it is a graded hierarchy of beings, many of which present feminine aspects of the divine, and all of which establish the metaphysical notion of interpenetrability. The second line of argument specifically contrasts her (...) thought to that of Aquinas and Meister Eckhart, noting areas of similarity and difference. It is concluded that the visionary origins of Hildegard’s work may have to some extent precluded our understanding of it, and that her work merits consideration not only philosophically and theologically but from the standpoint of its early presentation of a gynocentric worldview.
